Advisory Committee on the Prerogative of Mercy

Section 40

What, Why and How:

Investigations into potential grants of clemency to prisoners remain the responsibility of the Governor. The Governor holds special powers to pardon offenders, whether by remitting the whole or part of any sentence, but under the newly implemented constitution he must now solicit advice from the ACPM, even though their decisions are not ultimately binding.

Who:

ACPM Committee members include the Attorney General, Chief Medical Officer and four other members appointed by the Governor – two after consultation with the Premier, and two following consultation with the Leader of the Opposition.
