What, Why:

A new and independent office, called the Director of Public Prosecutions (DPP) is tol be established in the near future. This office assumes responsibility for criminal prosecutions. This is an internationally accepted good governance measure to ensure that Governments have no avenue by which they may influence decisions as to whether to prosecute cases. The DPP should be operational by fall 2010. The Attorney General, who previously held this remit, will remain the Government’s principal legal advisor.

How:

The DPP must decide whether:

1. to institute & undertake criminal proceedings against any person before any court in respect to an offence against any law in force in the Cayman Islands;
2. to take over and continue any criminal proceedings that have been instituted by any other person or authority;
3. to discontinue at any stage before judgment is delivered any such criminal proceedings instituted or undertaken by the DPP or any other person or authority.

When:

This office will be appointed following the establishment of the Judicial and Legal Services Commission (JLSC)
